This app ("the App"), operated by Maximilian Selmayr, provides a digital assistant for planning nutrition and hydration during endurance activities. By using the App or purchasing a subscription, you agree to these terms.

2. Services and Subscription Models

The App offers both free basic features and paid premium features ("Premium Subscription").

• Subscription Options: We offer monthly and annual subscription plans.

• Payment Processing: All payments are processed through the Apple App Store or Google Play Store. We use Adapty to manage subscription states and validate access.

• Automatic Renewal: Subscriptions renew automatically at the end of the billing period unless canceled at least 24 hours before the current period expires.

• Cancellation: You can cancel your subscription at any time within your App Store / Google Play account settings. Access to premium features remains active until the end of the current billing cycle.

3. Right of Withdrawal (EU/EEA Consumers)

If you are a consumer based in the European Union, you have a statutory right to withdraw from this contract within 14 days without giving any reason.

• Execution: To exercise your right, you must follow the refund procedures of the respective App Store (Apple or Google), as they handle the financial transaction.

• Early Expiration: You explicitly agree that we begin the performance of the service before the end of the withdrawal period. You acknowledge that your right of withdrawal expires once the digital content is made available to you.

4. AI-Generated Content & Disclaimer

The App uses Artificial Intelligence (AI) to generate nutrition suggestions.

• No Medical Advice: The content is for informational purposes only. It is not medical advice, diagnosis, or treatment.

• Accuracy: AI-generated plans may contain errors. We do not guarantee the accuracy, completeness, or safety of the generated plans.

• Individual Factors: The App cannot account for all individual health variables (e.g., metabolic disorders, allergies, or undiagnosed conditions).

5. User Responsibility and Health Risk

• Mandatory Testing: You are strictly advised to test any suggested nutrition strategy during low-intensity training sessions before using it in a competition or high-intensity environment.

• Listen to Your Body: If you feel unwell, experience gastrointestinal distress, or other health issues, stop following the plan immediately and consult a medical professional.

• Assumption of Risk: Use of the App and implementation of its suggestions are at your own sole risk.

6. Limitation of Liability

To the maximum extent permitted by law, Maximilian Selmayr shall not be liable for any indirect, incidental, or consequential damages, including health complications or performance issues, arising from the use of the App or reliance on the AI-generated content.

7. Availability and Changes

We reserve the right to modify or discontinue features to improve the service or reflect changes in the underlying AI models (e.g., Google Gemini). While we aim for high availability, 100% uptime is not guaranteed.

8. External Services

• AI Processing: Your inputs are processed via the Google Gemini API.

• Subscription Management: Subscription data is processed via Adapty. Please refer to our Privacy Policy for details on how your data is handled by these services.

9. Governing Law

These terms are governed by the laws of Germany.
